Charitable Associates Network (CAN)

The Charitable Associates Network (CAN) is a Colorado Not-For-Profit Corporation that has been established to provide contract laborers to charitable organizations and charitable projects in the United States and around the world.  Charities can contract with CAN to supply contract laborers with a variety of different talents and experiences who are available to provide the agreed upon services that are needed by the charities.  Network laborers are not employees of the charity or of CAN but are independent contractors.  As independent contractors, the contractors are responsible for their own Worker's Compensation Insurance and other fringe benefits and agree to hold CAN and contracting charities harmless for any accident or injury incurred during performance of the work as described in the Agreement.  Independent Contractors shall furnish the equipment and materials necessary to perform the duties required and the contractor takes full responsibility for any and all employees, associates or volunteers that he or she uses to accomplish the work.  Each contractor will sign an Independent Contractor Services Agreement that covers the description of the work to be done, the agreed upon compensation, the terms of the relationship and the charity or charitable project for which the work will be performed. What the Charitable Associates Network must have initially:

  1. A completed and signed Independent Contractor Agreement that states:A completed W-9 form since the person will be receiving a 1099 form at the end of the year reporting the income they have received.
    1. The project or organization to be served
    2. The scope of the services
    3. The estimated cost for the services and materials and when they need to be paid
    4. That the contractor is not an employee of the Foundation or the Charitable Associates Network but is providing his services as an Independent Contractor
  2. If work is to be done on a regular basis, the Independent Contractor Agreement can stipulate the amount to be received each month.  If it is to be based on specific projects accomplished, then the Independent Contractor should submit invoices for the services performed which will be approved by the Project Manager or charity.
What the Charitable Associates Network needs each year:
  1. A new Independent Contractors Agreement or confirmation of the existing agreement
  2. Invoices for services performed where appropriate or a description of the services to be provided.
If the Independent Contractors are living overseas providing their services, then they should be eligible for the foreign earned income exclusion, talk to your tax advisor.    In this case all funds, up to the specified amount of the contract, can be distributed to the Charitable Associates Network each month and then to the Independent Contractor as received by the Foundation.

In special instances the establishment of a nonprofit corporation employer for people who wish to be compensated from projects can be set up to assist with tax reporting and employee benefits.
